SweetzSync Affiliate Program — Terms & Conditions

The Program allows approved Affiliates to earn commissions by referring new paying customers to the following SweetzSync plans:

• SweetzOne — $97/month or $970/year
• SweetzUltimate — $197/month or $1,970/year

These are the only plans included in the Program. Plan names, features, and pricing may change at any time without affecting the validity of these Terms.

The Program is currently invitation-only and limited to a select number of Affiliates. Receiving an invitation or submitting an application does not guarantee acceptance.

To participate, you must:

• Be at least 18 years old and able to enter into a binding contract.
• Provide accurate, complete, and current information in your application and keep it updated.
• Maintain an active, legitimate online presence, audience, or network through which you will promote SweetzSync.
• Not be a current or former Affiliate whose account was terminated for cause.

We may accept or reject any application at our sole discretion and are not required to provide a reason. We may also remove an Affiliate from the Program at any time in accordance with Section 9.

Upon approval, you will receive a unique referral link. Commissions are earned only on purchases tracked through your referral link. We cannot credit sales that were not properly tracked, including sales where the customer cleared cookies, used a different device, or entered through a link other than yours.

Referral tracking uses a 365-day cookie. If a referred visitor purchases within that window, the sale is credited to you. If the visitor was previously referred by another Affiliate, the most recent valid referral is credited unless otherwise determined by us.

You may not modify, mask, shorten in a way that breaks tracking, or otherwise alter your referral link except through methods we approve.

Rate. Affiliates earn 30% of the net subscription revenue we actually collect from each referred customer on a SweetzOne or SweetzUltimate plan, for as long as that customer remains an active, paying subscriber ("recurring commission"). Net revenue means the amount paid by the customer after any discounts, refunds, chargebacks, taxes, and payment-processing fees.

Illustrative examples (at 30%):

• SweetzOne monthly ($97/mo) — approximately $29 per month for as long as the customer stays subscribed
• SweetzOne annual ($970/yr) — approximately $291 per annual payment
• SweetzUltimate monthly ($197/mo) — approximately $59 per month for as long as the customer stays subscribed
• SweetzUltimate annual ($1,970/yr) — approximately $591 per annual payment

What is not commissionable. Commissions are not paid on:

• Your own purchases, or purchases made through your own link for yourself or your business.
• Purchases by existing SweetzSync customers, including plan upgrades or downgrades of accounts you did not originally refer.
• SweetzSync Social plans (Post and Connect), which are not part of the Program.
• Add-ons, one-time products, usage-based rebilling (e.g., SMS, email, or AI usage), or any product not expressly listed in Section 1.
• Any sale that is refunded, charged back, or cancelled before the end of the holding period.

Changes. We may change the commission rate or commissionable products with 30 days' written notice. Changes apply to sales made after the effective date and do not reduce commissions already earned.

• Commissions are calculated monthly and paid via PayPal to the PayPal email you provided. You are responsible for keeping this information accurate; we are not liable for payments sent to an incorrect address you supplied.
• Commissions are subject to a 30-day holding period from the date of the customer's payment to allow for refunds and chargebacks. Commissions that clear the holding period are paid on or around the 15th of the following month.
• If a referred customer's payment is refunded, reversed, or charged back after a commission has been paid, we may deduct the corresponding amount from your future commissions.
• You are solely responsible for all taxes on commissions you receive. Affiliates in the United States whose commissions reach the IRS annual reporting threshold will be required to provide a completed Form W-9 before further payments are released, and we will issue a Form 1099 as required by law. Affiliates outside the U.S. may be asked for equivalent documentation (e.g., Form W-8BEN).
• PayPal fees, if any, are borne by the Affiliate.

You agree to promote SweetzSync honestly and in a way that reflects well on the brand. You must:

• Clearly and conspicuously disclose your affiliate relationship wherever you share your link, in compliance with the U.S. FTC Endorsement Guides and any applicable local law (for example: "I earn a commission if you sign up through my link").
• Represent SweetzSync's features, pricing, and results accurately. Do not promise specific income, revenue, or business outcomes.
• Use only marketing materials we provide, or materials you create that we have not objected to. We may ask you to remove or modify any material at any time.
• Direct all customer support questions about the platform to SweetzSync support (contactus@sweetzsync.com) rather than attempting to provide technical support yourself.

You must not:

• Send unsolicited bulk email, messages, or comments ("spam"), or post your link in places where it is unwelcome or prohibited.
• Bid on, purchase, or otherwise use the terms "SweetzSync," "Sweetz Designz," "Sweetz Digital HQ," or any misspellings or variations as paid search keywords, or run paid ads that direct to SweetzSync pages in a way that competes with our own advertising.
• Register domain names, social handles, or create pages that could be mistaken for official SweetzSync properties.
• Use cookie stuffing, forced clicks, iframes, pop-unders, incentivized clicks, or any deceptive or automated method to generate referrals.
• Offer unauthorized discounts, rebates, cash-back, or coupons in connection with SweetzSync.
• Make disparaging, false, or misleading claims about SweetzSync or competing products.
• Promote SweetzSync alongside content that is unlawful, hateful, sexually explicit, or otherwise objectionable, as determined by us.

We grant you a limited, non-exclusive, revocable license to use the SweetzSync name, logo, and approved marketing materials solely to promote the Program under these Terms. You may not alter our logos or materials, imply endorsement of your other products or services, or use our brand in any way that suggests you are an employee, agent, or official representative of SweetzSync. This license ends automatically when your participation ends.

You are an independent contractor. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship. You have no authority to make commitments on our behalf, and you are responsible for your own expenses, taxes, and business decisions.

These Terms begin when we approve your application and continue until terminated.

• You may leave the Program at any time by notifying us in writing at contactus@sweetzsync.com.
• We may terminate your participation at any time, with or without cause, on written notice. Termination for a violation of Section 6, fraud, or conduct we believe harms the SweetzSync brand is effective immediately.

Upon termination: you must stop using your referral link and all SweetzSync branding immediately. Recurring commissions on customers you previously referred end on the termination date. If you leave voluntarily or are terminated without cause, commissions already earned and cleared as of the termination date will be paid in the normal payment cycle. If you are terminated for cause, all unpaid commissions are forfeited.

Non-public information about SweetzSync, including unreleased features, pricing plans, commission structures, and Program details, is confidential. You agree not to disclose it without our written permission, during or after your participation.

The Program and all materials are provided "as is." We do not guarantee any level of earnings, traffic, or tracking accuracy. To the fullest extent permitted by law, our total liability to you under these Terms will not exceed the total commissions paid to you in the six (6) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits.

You agree to indemnify and hold harmless Sweetz Designz, LLC, its owners, members, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your promotional activities, your breach of these Terms, or your violation of any law or third-party right.

We may update these Terms from time to time. We will notify active Affiliates by email at least 14 days before material changes take effect. Continued participation after the effective date constitutes acceptance. If you do not agree, your only remedy is to leave the Program under Section 9.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Program will be resolved exclusively in the state or federal courts located in Orange County, Florida, and you consent to that jurisdiction and venue.

If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Sweetz Designz, LLC regarding the Program and supersede any prior understandings. You may not assign these Terms without our written consent.
